By accessing this website and/or placing an order you agree to accept these terms and conditions and that you consent to us contacting you or using your information as detailed in our privacy policy. If you disagree with any part of these terms and condition, please do not use this website.

1.      Introduction

This website is owned by and operated by or on behalf of DAWNROSE PEARLS Limited (“DawnRose Pearls/we/us/our”). This company is registered in England and Wales. Registered office: Suite 29 3rd Floor Clayton House, 59 Piccadilly, Manchester, M1 2AQ. Registered number 7855478.

Reference to ‘buyer’, “you” and/or “your” mean the purchaser buying the goods (“Product/Products/Goods”) from us subject to these Terms and Conditions.

DawnRose™ and Where Love Finds Expression™ are trademarks of DawnRose Pearls Ltd., and owned by DawnRose Pearls Ltd.

Any use, including reproduction, modification, distribution, transmission, republication, display or performance of content on this site inclusive of texts, graphics, product pictures, images, logos and video clips, are strictly forbidden without authorization by DawnRose Pearls.

2.     Scope

These Terms and Conditions, together with any other policies referred to in these Terms and Conditions (including any policies or documents to which a link is provided from these terms and conditions) (together “Terms”) apply to all orders submitted by you for products made available by us for purchase over this website. Please read these Terms carefully. Please note that these Terms do not affect your statutory rights as a consumer. For more information on your statutory rights, contact your local Trading Standards Office or Citizens Advice Bureau.


3.    Order Acceptance

We must receive payment in full for the price of the products that you order prior to our acceptance of your order. Once payment in full has been received by us, we shall acknowledge receipt of your order by sending you an email to the email address that you provided in your order form. This does not constitute our acceptance of your order. Our acceptance of your order takes place when we dispatch the goods ordered unless we have previously notified you that we do not accept your order or you have cancelled your order. We do not accept orders from persons under the age of 18 or from persons who are unable or are not authorised to enter into legally binding contracts through this site. If you do not qualify to do so please do not use this website.

DawnRose Pearls may reserve the right not to accept your order if:
3.1 we have insufficient stock to deliver the products you have requested or is no longer available;
3.2 we do not deliver to your area;

3.3 the information you provided is not true;
3.4  one or more of the items you ordered was priced incorrectly due to a typographical error or resulting from a fluctuation in the prices of precious metals or gems.

If we do not accept your order we will notify you by email and we will credit your account with any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We shall not be obliged to offer any additional compensation for disappointment suffered.
 


4.    Price and Payment

The prices payable for the Products that you order are those set out in our website and include Value Added Tax (VAT) in the UK at the rate prevailing at the time of dispatch.

If you purchase from outside the UK, currency fluctuations, credit card and bank charges may make a difference to the amount you are billed on your credit card or bank advice/statement.


5.    Delivery

We will deliver the Products ordered by you to the address you provide us for delivery at the time you place your order. It is your responsibility to ensure that the delivery address you give is correct and accurate.

Your order will be despatched within 1-2 working days from when the order is placed. Please allow up to 5 working days to process your order at some special occasions (such as Christmas, Valentine’s day and Mother’s day) or for complicated customized items. The delivery time frame may not apply for P.O, A.P.O or B.F.P.O destination addresses. Please contact our order management team in the unlikely event that your order is delayed over 2-3 days and we will immediately check into it. Packages should be inspected upon receipt and if there is any visible damage which is suspected to be caused by shipping, it must be reported to our order management team via email within 5 working days.

If shipping address is different from your billing address (when for example, you are sending a gift and want it sent directly to the recipient) please fill in the billing address next with your own credit card address, and set the intended recipient’s address as the shipping address. Please check your addresses carefully when checking out. DawnRose Pearls is not responsible for any undelivered or misdelivered item because of invalid or miswritten addresses, if so, the item will be returned to DawnRose Pearls and the postage charge will apply.

We shall use its reasonable endeavours to meet any date agreed for delivery. In any event we shall not be liable for any losses, costs, damages or expenses incurred by you or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.


6. Import Duty

 If you order Products from our site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.

 


7.  Liability

7.1 If the products we dispatch do not comply with your order or are damaged or defective or the quantity delivered is incorrect we shall have no liability to you unless you notify us by email or telephone of the problem within 7 working days from the date of delivery of the products.
7.2 If you do not receive the products within 7 working days from the date of your receipt of our acknowledgement of your order we shall have no liability whatsoever to you unless you notify us by email or telephone of non-delivery within 14 days of the date of our acknowledgement of your order. If you notify us of non-delivery in accordance with this clause our sole obligations will be at your election either:
          
7.2.1   to make good any shortage or non-delivery; or
7.2.2   to replace any Products that are damaged or defective; or
7.2.3   to refund to you the amount paid by you for the products in whatever
way we choose.
7.3    Notwithstanding the foregoing nothing in these terms is intended to limit any statutory rights you have as a consumer.
7.4   We will not be held responsible for any delays once we have dispatched goods and they are in possession of the courier and/or Royal Mail.

 
8.     Variation of Content on the Website

DawnRose Pearls reserves the right to adjust the price and specification of any item on the website at its discretion and at any time.
DawnRose Pearls reserves the right to withdraw any goods from the website at any time.

 

10.     Privacy Policy

You acknowledge and agree to be bound by the terms of our privacy policy which forms part of these Terms.

11. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the law of England and Wales and the parties hereby submit to the exclusive jurisdiction of the English courts.

Permission is granted to electronically copy and to print in hard copy this web site for the sole purpose of placing an order with DawnRose Pearls. No permission is given by us in respect of the use of any such intellectual property including brand names, photographs, product names, titles or copyrights and such use will constitute an infringement of the owners' rights.
